Lake St. Clair Chapter Liability Waiver Form

I acknowledge that boating has inherent risks, hazards, and dangers for anyone which cannot be completely eliminated, particularly around an aquatic environment. I understand that these risks, hazards, and dangers include without limitation:

1. Drowning while engaged in boating and swimming.
2. Injuries received from mechanical and moving boat parts.
3. Injuries received from others, including my boat host or his equipment.
4. Injuries received from encounters with wildlife and insects.
5. Injuries received from exposure to the sun, lighting, wind, weather, and elements.
6. Injuries received from fires while on a boat.
7. The absence of rapid medical attention/emergency response.

I understand the risks, hazards, and dangers of boating, and I understand that these activities may require good physical conditioning and a degree of skill and knowledge. I believe I have that good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely. I understand that I have responsibilities.

I also understnad that photographs will be taken. I hereby grant Boat4Vets permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I am voluntarily participating in this Boat4Vets event with full knowledge of the inherent risks, hazards, and dangers involved, and hereby assume and accept any and all risks of injury, paralysis, disability, or death.

Lastly, I, for myself, my heirs, successors, executors, and subrogees, I hereby knowingly and intentionally waive and release, indemnify, and hold harmless the following: Boat4Vets, The St. Clair Council on Aging, VFW Post 3901, to include the officers, agents, drivers and volunteers, boat owners and the operator of the boat(s) from and against any and all claims, actions causes of action, liabilities, suits, expenses (including reasonable attorney’s fees) which are related to, arise out of, or are in any way connected with my participation in this activity. This provision includes but is not limited to, negligence, gross negligence, and/or intentional acts by third parties of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, disability, or death to me or my property as a result of my engaging in these activities or the use of these services, property or equipment.

I, for myself, my heirs, my successors, executors, and subrogees, hereby agree not to file suit against Boat4Vets, The St. Clair Council on Aging, or VFW Post 3901, to include the officers, agents, drivers and volunteers, boat owners and the operator of the boat(s) as a result of any injury, paralysis, disability or death suffered in connection with my use and voluntary participation in this charitable event.                                            

This waiver is governed by the laws of the State of Michigan. If any portion of this waiver is deemed unenforceable then that portion shall be stricken, and the remainder of this waiver shall be left intact.
